1. Acceptance of Terms
By accessing or using Pooled (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time, and continued use constitutes acceptance of any changes.
2. Eligibility
You must be at least 18 years old and legally able to enter into binding agreements to use the Service. By creating an account, you represent that you meet these requirements.
3. Accounts
You are responsible for maintaining the security of your account credentials. You agree to notify us immediately of any unauthorized access. We are not liable for losses arising from unauthorized use of your account.
4. Identity Verification
To comply with applicable Know Your Customer (KYC), anti-money laundering (AML), and other regulatory requirements, we may require you to verify your identity before accessing certain features of the Service, including but not limited to creating pools, receiving payouts, or exceeding transaction thresholds.
You hereby authorize Pooled, directly or through our use of third-party identity verification services, to make any inquiries we consider necessary to validate your identity. This may include:
- Requesting your legal name, date of birth, address, Social Security number or taxpayer identification number, or other government-issued identification.
- Verifying your information against third-party databases, credit bureaus, or other sources.
- Requiring you to submit photographs of government-issued identification documents.
- Confirming ownership of your email address, phone number, or linked financial accounts.
You agree to provide information that is accurate, current, and complete. You agree to cooperate with any verification request and understand that providing inaccurate, misleading, or incomplete information may result in the suspension or termination of your account.
If we are unable to verify your identity to our satisfaction, we reserve the right to restrict, suspend, or close your account and to decline any pending or future transactions. We are not liable for any losses arising from delayed or restricted access due to incomplete or failed identity verification.
5. Pools
A “pool” is a group collection created by an organizer. The organizer sets the price per person, contributor limits, and funding deadline. By creating a pool, you agree to use collected funds only for the stated purpose.
6. Contributions
By contributing to a pool, you authorize the specified payment amount. Contributions are processed through our payment provider. All contributions within a pool are equal and set by the organizer.
7. Refunds
If a pool does not reach its funding goal by the deadline, all contributions are automatically refunded. If a pool is cancelled by the organizer, all contributions are refunded. Refund processing times depend on your payment method and may take 5-10 business days.
8. Fees
Pooled charges a platform fee on each contribution. The fee percentage is displayed when you create or contribute to a pool. Fees are non-refundable once a pool is successfully funded.
9. Payouts
When a pool is fully funded, the organizer can withdraw funds to their linked bank account. Payout processing times vary by method. Pooled is not responsible for delays caused by banking institutions.
10. Prohibited Use
You may not use the Service for illegal activities, fraud, money laundering, or any purpose that violates applicable laws. We reserve the right to suspend or terminate accounts that violate these terms.
11. Limitation of Liability
Pooled is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service.
12. Dispute Resolution
Disputes between pool organizers and contributors should be resolved between the parties directly. Pooled facilitates payments but is not a party to the underlying transactions or agreements between users.
13. Changes to Service
We reserve the right to modify or discontinue the Service at any time. We will provide reasonable notice for material changes that affect your existing pools or funds.
